This area of litigation, sometimes called “products liability,” involves customer products that cause injuries because of defects in their manufacturing or design, or undisclosed risks. For example, a toaster oven is supposed to toast food. A toaster oven that sparks a fire may result from a flaw in the manufacturing process or design process. A consumer may sue for damages related to such fire.
Sometimes, the product wholly fails to serve its intended purpose. For example, the roof of a car has a straightforward purpose: protecting the car’s occupants in an accident or rollover. A roof that crushes and fails to protect its occupant may be a defective product.
