WRONGFUL DEATH

Wrongful death. This is an unfortunate byproduct of life in a hazardous society.  When someone you love dies, there is always a tendency to review the circumstances to determine what went wrong and whether someone was at fault.  Death is a wrench from someone that you love.  At The Spencer Law Firm, we have experience in reviewing all facts and circumstances to assist you in determining whether your loved one died as a result of someone’s wrongdoing.  This death can be the result of a number of causes. 

Negligence Cases.  General negligence and gross negligence cases are the most common form of a wrongful death case.  They arise out of construction accidents, drownings, car accidents, physical assaults, slip and falls, animal attacks and just about any other circumstance where a person suffers such catastrophic injuries that death results due to the carelessness and/or indifference of another person or company.

 Product Liability Cases.  Death from product liability cases arise when a person dies through the normal use of an object, machine or structure, because the product is not fit to be used for its intended purpose.  If a product is not be fit to be used for its intended purpose, either as a result of its design or as a result of some event that occurred during the manufacture of the product, then its failure comes within the subject matter of product liability.  For example, if you purchase a teething ring, and the outer rubber is so thin it fails and allows the liquid on the inside to leak out and poison your child, then the product likely failed because of a defect in either the design or the manufacturing process. 

Medical Malpractice Cases.  Medical Malpractice death cases arise when a person dies as a result of a healthcare professional rendering services that fall below the healthcare standard of care.  The biggest misconception about medical malpractice, and one that is fueled by the media and special interest groups, is that such cases arise when Doctors make mistakes.  That is a false perception.  Healthcare professionals make mistakes all the time, but very few mistakes are actionable and result in death.  To be actionable, mistakes must fall below what is know as the “accepted medical standard of care.”
