Product Liability Cases. Product liability cases arise when a person is injured, through the normal use of an object, machine or structure, because the product is not fit to be used for its intended purpose. If a product is not be fit to be used for its intended purpose, either as a result of its design or as a result of some event that occurred during the manufacture of the product, then its failure comes within the subject matter of product liability. For example, if you purchase a teething ring, and the outer rubber is so thin it fails and allows the liquid on the inside to leak out and poison your child, then the product likely failed because of a defect in either the design or the manufacturing process. Medical Malpractice Cases. Medical Malpractice cases arise when a person is injured as a result of a healthcare professional rendering services that fall below the healthcare standard of care. The biggest misconception about medical malpractice, and one that is fueled by the media and special interest groups, is that such cases arise when Doctors make mistakes. That is a false perception. Healthcare professionals make mistakes all the time, but very few mistakes are actionable.
