Ralph J. Miller, Patrick McKenna and Michael Swiney have filed a class action lawsuit against TaxMasters and Patrick Cox in the United States District Court, Southern District of Texas, Houston Division. The class plaintiffs intend to seek certification by the Court to represent all individuals nationwide who have not signed an agreement with TaxMasters and have paid money to TaxMasters for services never performed in whole or in part. Potential Case Regarding Transvaginal Mesh Manufacturers
On July 13, 2011, the Federal Drug Administration issued an announcement warning patients and physicians about the dangers of transvaginal mesh (TVM), an medical device implant used to prevent pelvic organ prolapse and also used in connection with various urogynecologic procedures. Arbitration Victory
The Spencer Law Firm started 2011 with a BANG. On January 4, 2011, Dawn Meade won an arbitration verdict after battling Houston law firm PORTER & POWERS in a four day arbitration of the case Betty Vincent v. Wellington Yu and The Peterson Group, Inc. Betty Vincent is a California resident who purchased two commercial properties, located in Fort Bend and Galveston Counties, from the extremely successful Houston area real estate developer Wellington Yu and his company, The Peterson Group. After reviewing Ms. Vincent's records, Dawn Meade filed suit against Yu and The Peterson Group for fraud in a real estate transaction, breach of fiduciary duty and breach of contract. The arbitrator ruled in Ms. Vincent's favor awarding her the return of her investment, as well as other damages, including attorney fees, arbitration costs and pre and post judgment interest. Dawn also defeated The Peterson Group's counter-claims against Betty Vincent.
Arbitration is not a preferred venue for trying lawsuits. Mandatory Arbitration clauses have become more prevalent on all types of commercial contracts, including the purchase of homes and cars, bank loan documents, etc. Dawn Meade has far less confidence in the fairness of the arbitration system than she has in our jury system. Nonetheless, trial lawyers adjust for the venue and Ms. Vincent's award is very comparable to that which the Spencer Law Firm would expect a jury to award in the same case if a jury trial had been allowed.
Judgment Won in Suit against Former Partner and Officer
Krista R. Fuller obtained a judgment against a former limited partner and officer for his breach of the partnership agreement and fiduciary duties. In this complex commercial suit filed in January of 2008, Empty Eye, Inc., Empty Eye & Associates, L.P. and Judith Lyn Daniels alleged breach of contract, breach of fiduciary duty, and business disparagement against Jiles Daniels, President of Empty Eye, Inc. and limited partner of Empty Eye and Associates. This case proceeded to trial in October of 2009 on the contract and fiduciary duty claims, and our clients wholly prevailed on both causes of action. Mr. Daniels was found to have breached the limited partnership agreement with his fellow partners, and also to have breached his fiduciary duties to the corporation of which he was President. On December 4, 2009, Judge Weiman in the 80th District Court of Harris County, Texas entered a judgment awarding our clients actual damages attorneys’ fees pre- and post-judgment interest, and costs of court. The verdict is currently on appeal.
Commercial Real Estate Breach Of Contract And Fraud
In July, 2009, Dawn Meade and Gregory Finney won a two week long trial in a case styled The Peterson Group, Inc. , et al. vs. PLTQ Lotus Group, LP, et al. Ms. Meade and Mr. Finney represented the defendant, PLTQ Lotus Group, LP in the case, which was tried to jury verdict in the 152nd Judicial District Court, Harris County, Texas. The Peterson plaintiffs sued PLTQ Lotus Group, L.P. for breach of contract associated with the purchase of one piece of commercial property and the construction of a shopping center on another piece of commercial property. PLTQ Lotus Group, LP filed a counter-claim, accusing the Peterson plaintiffs of breach of contract and fraud. Peterson sought damages of nearly $2 million and attorney fees of over $800,000.00.
After deliberating for approximately three hours, the jury found against Peterson on all of its claims and for PLTQ Lotus Group, LP on its claims of breach of contract and fraud. The jury further awarded PLTQ Lotus Group damages and attorney fees. The verdict is currently on appeal.
